Television licence illegal under EU legislation

There’s so much going on at the moment that it’s difficult to know where to start. So it seemed a good idea to opt out of the doom and gloom news and go for this wonderful idea from our western neighbours. It seems that demanding a television licence is not legal under EU law. We all know that being in possession of a TV without a licence is supposedly not permitted.  The Irish, bless their hearts, are proposing a TV amnesty in December when they are encouraging those with old TVs to dump them on the steps of the national broadcaster, RTE. Love it! Brilliant idea.

What is the situation here? As this appears to be a trading violation wouldn’t it come under protocol 3?
